Terms of service

  1. Cargolia is a licensed and bonded shipping company that is bonded by the FMCSA. We agree to arrange a variety of shipments, as described in the quote on or about the available dates, depending the our carriers’ schedules. Cargolia is a broker and cannot guarantee specific collection and delivery dates. We only provide estimates and make no guarantees. Cargolia will designate a reliable transporter to carry out and fulfill the services according to the terms and conditions of the agreement. The company will not be held liable for delays for any reason after we have confirmed your scheduling with a transportation provider.
  2. When you confirm your order with Cargolia, it will be subject to the carrier’s terms and conditions, including the bill of lading. Copies may be obtained from the carrier’s offices. Once a transporter has been assigned to your order, the bill of lading will come into effect, and it will be the only agreement in effect, along with the transporter’s terms and conditions.
  3. The transporter will not be responsible for damages not resulting from the carrier’s negligence.
  4. If the carrier is sent to collect your shipment and it is not available, or it has been moved and cannot be collected for whatever reason, the customer authorizes Cargolia to charge an additional re-posting fee to your order to facilitate re-posting of your order to the dispatch department for rescheduling, depending on the first available date provided at the time of ordering.
  5. The customer must, in their absence, designate a person to act as their agent as the collection and delivery point on the order form. The customer may be notified for collection in a minimum or 3-24 hours.
  6. All shipments delivered with a balance owing shall be paid in cash or cashier’s check only (U.S. dollars) payable to the transporter on delivery. Should delivery be attempted after proper notification (3-24 hour advance notice via phone message or text to the numbers provided) and the proper funds are unavailable, the shipment will be delivered to the nearest terminal. The shipper will have to retrieve the goods after paying the balance owing, along with storage and redelivery fees. If the customer is unable to pay the balance in cash or cashier’s check, the shipment will be stored at the customer’s expense.
  7. If the transporter is unable to drive to the address at delivery time, the customer agrees to meet the transporter at a nearby location.
  8. If the customer is unable to accept the shipment at the time of delivery, the shipment will be stored at the customer’s expense.
  9. The carrier has primary insurance responsibility during transit. All claims will be settled at actual cost. Claims are to be made to the carrier who transported the shipment. The claims process can be obtained from the transporter’s bill of lading. The customer agrees that the transporter’s bill of lading is the only contract between the parties arranging the transportation. No other contracts or agreements are in effect until the scheduling arrangement has been made with the authorized carrier. No claims or legal action may be initiated against the shipping broker.
  10. Any damage exceptions must be noted during the post-transport inspection form at the time of the delivery. No damages claims may be made for damages that were not documented on the post-shipping inspection form.
  11. All legal action, claims and litigation must have a right of venue in Colorado, County of Denver in the Superior Court.
  12. Orders may only be cancelled before the deposit payment is submitted. All cancellations must be made in writing, by email or fax.
    • Cancellations prior to the shipment being assigned to a carrier will be entitled to a refund less administration fees.
    • No refund is available for orders cancelled after being assigned to a courier.
    • If your shipment is not scheduled for pickup within five days from the first available date, you are entitled to a full refund.
  13. Cargolia reserves the right to refuse service to any person or company that violates these terms and conditions, or for any other reason we deem unacceptable, such as threats or harassment. Such behavior will result in an immediate cancellation or your order. A non-refundable administration fee will be levied against your account if we have actively worked on your order.
